The website ZELYA (hereinafter “ZELYA”) offers several types of services through its website www.zelya.ma (hereinafter the “Website”).
These activities are carried out under the brand “ZELYA” and are operated by the Website, managed by ZELYA.
The Website is open to all Internet users.
ZELYA’s main activity is:

The sale of fashion jewelry and related items on its Website.
These General Terms and Conditions of Sale of ZELYA are intended to define the rights and obligations of the parties in the context of the sale of services and products to Clients of the Website.
They apply, without restriction or reservation, to all sales of products and services offered by ZELYA on the Website. Any order placed on the Website or affiliated websites belonging to ZELYA implies acceptance of these General Terms and Conditions of Sale, which the client acknowledges having read, understood, and accepted in full.
These General Terms and Conditions of Sale are available in French, which shall prevail in the event of any contradiction. Clients may save and print them.
These General Terms and Conditions of Sale are governed by Moroccan law.
ZELYA reserves the right to modify these General Terms and Conditions of Sale at any time, without prior notice, provided that such modifications will not apply to reservations and Orders previously accepted and confirmed by the Client.
Acceptance of Terms
By making a purchase on our website, you confirm that you have read and understood our General Terms and Conditions of Sale as well as our shipping and refund policies. By placing an order, you fully and unreservedly accept all of these conditions. The client is solely responsible in the event of non-compliance with these terms.
Legal Capacity
By subscribing to our Services on our Website, you guarantee that you meet all the following criteria:
a) you are legally capable of entering into contracts and, more generally, legal acts that bind you;
b) you are over 18 years old;
c) you have the skills, equipment, and software required to use the Internet, and you fully understand and assume the characteristics of the Internet and its use, particularly the limitations related to technical performance, response times, and risks related to communication security.
Therefore, ZELYA declines any liability in the event of anomalies, errors or bugs, breakdowns, or unscheduled interruptions of the Website.
ZELYA may, in this respect, freely determine any period of unavailability of the Website or any of its sections, for technical reasons, content improvement, or optimization of its use.
Geographical Area
ZELYA’s products and services are offered exclusively in Morocco.
Service Availability
Except in unforeseen circumstances beyond the control of ZELYA, the Website is normally accessible to Clients 24/7 all year round, except in cases of force majeure, public holidays, or festive periods.
ZELYA cannot, under any circumstances, be held responsible for any physical, material, or moral damage caused by the unavailability of the Website.
Pricing of Services and Products
The selling prices of services and products listed on the Website are indicated in Moroccan dirhams, all taxes included. Products ordered are invoiced at the prices in effect at the time the order is recorded.
Prices may be modified by ZELYA at any time, and any change will be notified to the Client before placing an order.
Shipping fees will be indicated before the Order is confirmed.
Availability
Offers presented by ZELYA are valid as long as they are displayed on the Website and within the limits of available stock.
In case of unavailability of one or more products or services after the order is placed, the client will be notified by email, WhatsApp, or phone call.
The order amount will then be recalculated, and the client will be charged only for the available items.
If the entire order is unavailable, the Client will be notified by email, WhatsApp, or phone call and will not be charged or will be refunded. In such cases, ZELYA cannot be held liable for any damages incurred by the Client.
Refund Policy
Our refund policy applies as follows:

Defective or Quality-Altered Items: If the received items are defective or show quality deterioration over time, a refund of 90% of the paid amount will be granted after receipt and inspection of the returned merchandise.

Other Cases: For all other situations not related to defects or quality issues, ZELYA reserves the right to determine the refund percentage, ranging between 20% and 65% of the paid price, depending on the condition of the product and order circumstances.
Orders
When the Client confirms an Order by clicking on the “Confirm your order” or “Buy Now” button, they are deemed to have knowingly accepted the content and conditions of the order, particularly these General Terms and Conditions of Sale, prices, volumes, characteristics, quantities, and delivery times of the products offered for sale.
ZELYA will then confirm this order by sending an email and/or a confirmation message via SMS, WhatsApp, or a phone call to the Client.
ZELYA also reserves the right to suspend or cancel any order and/or delivery, regardless of its nature or level of execution, in case of non-payment, partial payment, payment incident, fraud, or attempted fraud relating to the use of the Website, including for previous orders.
In the event of an error in entering the client’s email address or failure to receive the order confirmation email, ZELYA cannot be held responsible. In such cases, the sale will be considered final, except for order cancellations made by ZELYA (notably in case of product unavailability).
Cash on Delivery
After validating the order, the Client will receive an order summary via WhatsApp or phone call.
The Client is required to pay in cash upon delivery.
ZELYA reserves the right to suspend or cancel any Order and/or delivery in case of non-payment or payment incident.
Delivery of Orders
Products purchased on the Website are delivered only within Morocco (unless specifically mentioned during the sale).
They will be delivered to the address provided by the Client when placing the order.
Delivery times indicated on the Website are indicative, based on average processing and shipping times observed.
ZELYA cannot be held liable for consequences due to delivery delays.
If the package is returned to the sender, a second delivery will be at the Client’s expense.
If the package is returned again, it will no longer be reshipped, and the corresponding order amount, including extra delivery fees if applicable, will remain with ZELYA.
Returns
Within 3 to 5 days of receiving their order, the client may request a return to ZELYA, with a refund of up to 90% depending on the situation.
Return shipping costs (45 MAD) are borne by the Client.
If the product is not returned within 5 days of receipt, or not returned in its original condition, the return is considered void and the Client must keep the product.
Refunds are processed within 30 days of ZELYA receiving the returned product, credited to the client’s bank account.
The client must notify ZELYA of any reservation upon delivery (damaged package, opened package, missing items) within 3 days of receipt.
If the product is confirmed defective, the client may receive a full refund or a replacement product, subject to stock availability. If out of stock, an equivalent product will be provided.

Return & Refund Policy
The client must check their order upon delivery in the presence of the courier.
If the order does not meet expectations after payment and verification, ZELYA may offer a refund, deducting delivery fees (19 – 45 MAD) and possible return costs (10 – 50 MAD).
ZELYA cannot be held responsible for refund requests after receipt of promotional or discounted items. In such cases, a partial refund may be offered if the client chooses not to exchange the product.
